Knowing If HIPPA Is Your Best Option

People have a wrong notion that if they are willing pay the desired premium they can purchase any type of health insurance coverage from any insurer. This notion comes from the way there is extreme competition in the insurance business and the way insurers chase those who intend to purchase health insurance coverage. However, the fact is that there are many preconditions to purchasing health insurance coverage.

In fact, before the enactment of the Health Insurance Portability and Accountability Act (HIPAA) in 1997, it was an impossible task for people with preexisting medical conditions such as diabetes, heart disease, and cancer to get health insurance coverage. They had no option of health insurance, once turned down by health insurance providers.

In that situation, if you had to get a new insurer due to a change in your job, you might not have been able to get some of your risks covered because of the preexisting condition exclusion.

However, after the implementation of HIPAA health insurance rules through the Health Insurance Portability and Accountability Act (HIPAA), coverage for employees and their dependents continues regardless of the preexisting conditions. Now, in case of HIPAA health insurance, the health insurance company can impose a maximum of a 12-month waiting period for any preexisting condition that has been diagnosed or treated within the preceding six-month.

Advantages Of HIPPA Health Insurance

A major advantage of HIPAA health insurance is that if you have maintained continued coverage without a break of more than 63 days, your prior health insurance coverage would be credited toward the preexisting condition exclusion period.

HIPPA Health Insurance Characteristics

HIPAA health insurance is used for the Health Insurance Portability and Accountability Act (HIPAA) under which participants and beneficiaries of group insurance plans have been empowered through rights and protections. HIPAA health insurance:

  • protects people with preexisting condition for coverage under group health plans

  • prohibits discrimination against employees/dependents on their health status

  • allows individuals with special opportunity to enroll in a new plan

  • gives right to purchase individual coverage in the absence of group plans/COBRA

HIPPA Health Insurance And Preexisting Conditions

Let’s understand it this way - If you have changed your job and your health plan but you have had group insurance coverage for a minimum period of 1 year before changing your job, your new health plan would not impose another preexisting condition exclusion period. However, if you never had any employer’s group insurance plan and you joined a job which offers group insurance plan, you may have to undergo the 12-month preexisting condition waiting period.

HIPAA health insurance laws also made it easier for you to get individual insurance under certain situations, if you are willing to pay a higher premium in case you have a preexisting medical condition.

Another aspect is that if you have never had any coverage and now all the insurers have turned down your request for health insurance coverage citing a preexisting medical condition as the reason, you may get coverage if your state manages any high risk pool. A high risk pool provides coverage to those who have been turned down by insurers due to their existing medical condition.

There is also a unique benefit offered to those who have a preexisting condition and are covered through HIPAA law. This benefit is called the HIPAA Privacy Rule and is enforced by the Office for Civil Rights. According to this rule the Office for Civil Rights protects the privacy of individually identifiable health information of those who have been covered under the HIPAA law.

Therefore, if you have any preexisting condition, you do not need to worry about revelation of any of your medical information if you get coverage through HIPAA since the law has already taken precaution in this regard.
